The certificate of non-debt of TAP in real estate transfers is abolished


The benefit in real estate transactions from the imminent abolition of the non-debt certificate of the real estate fee (TAP) will be significant, as a document that often took up to three months to be granted to the interested parties is expected to be erased. As stated by the Deputy Minister of Interior St. Petsas at the 39th Panhellenic Conference of Property Owners of POMIDA, which took place on Saturday, a provision has already been prepared for the abolition of the TAP certificate in real estate contracts.

It is worth noting that the certificate of non-debt of TAP was abolished in 2014, but returned in 2017. This is another document that was added to the list of required certificates and certificates that must accompany every purchase and sale of real estate today, a development that has brought our country to 153rd worst position in the world, according to World Bank data.

Today, the certificate of non-debt of TAP (collected through PPC accounts) is a significant obstacle in speeding up the process of buying and selling real estate. According to the president of the notaries, Giorgos Rouska, "for the simple cases of transfers it takes one month, while for the more complex ones from three to nine months". As he mentioned, the delays certainly include the issuance of a TAP certificate, for example in the Municipality of Thessaloniki 4,000 applications are pending, while other cases of delays concern the issuance of tax information, issues with forest maps and the issuance of insurance information.

As POMIDA President Stratos Paradias pointed out at the conference, the extensive tax and urban planning "certification" in real estate transfers has turned them into Golgotha ​​and reminded of the need to abolish certificates, such as the one for TAP, but also the possibility of their electronic issuance. The government now seems to be focusing on this point as well.

According to the commander of AADE George Pitsili, the newly established platform myProperty has already received 105,000 tax returns, donations and parental benefits, while in the last 10 days alone more than 20,000 applications have been submitted. This platform concerns the electronic certification and issuance of the transfer tax that accompanies each purchase. The capabilities of the platform are expected to be expanded within the year, to cover both inheritances and informal donations. Also, during 2022, the digitization of the issuance of tax information and debt certificate will be implemented, while another important development concerns the fact that the preparation for the interconnection of the AADE database with the Land Registry has begun.

However, in the coming months, the application of the electronic building ID in the purchase and sale of new real estate is expected to begin, which not only maintains all the documents required until today, but also adds the attachment of the building permit and the plans that accompany, the certificate of construction control, if it has been issued, as well as any declarations of compliance with laws suspending the imposition of sanctions on arbitrary, floor plans, the structural vulnerability of the building and so on.
Developments should be expected regarding ENFIA as well, as both the Minister of Finance Chr. Staikouras and the Deputy Minister of Finance Th. Skylakakis noted that the new tax will be lower and fairer. "In the coming weeks, the new ENFIA will be announced, which will be much fairer and will alleviate the extreme injustices it had in the beginning and has continued to have this tax for many years," said Mr. Skylakakis.
